The Spot is run by Wyatt Eiden LLC Eau Claire, WI 54701, United States. Questions, problems and takedown requests: support@thespot.page. By using the site or paying for the spot, you agree to these terms.
How the spot works
- The site shows one photo at a time. The price starts at $1 and is always $1 more than the last photo that went up.
- You pick a photo, type the name to show with it, and pay. Paying puts you in line — it does not put your photo up.
- We review every photo. If yours is picked, it goes up and your card is charged. If it isn't, nothing is charged.
- Your photo stays up until someone pays more. That can happen minutes later or never. There is no minimum time on the spot.
- Up to five people can be in line at once, and you have two minutes to pay once you pick a photo. These keep the line moving and may change.
Payments, holds and refunds
- Payments are handled by Stripe. We never see or store your card details.
- When you pay, your bank places a hold for the amount. A hold is not a charge. Your bank may show it as pending.
- You are charged only when your photo goes up. Everyone else's hold is released.
- If we don't review your photo within five days, the hold is released automatically.
- Once your photo has gone up, the payment is final: you paid for the spot, and you got it. If something went wrong, email us and we'll sort it out — we can refund at our discretion.
- If we take your photo down for breaking the rules below, we don't refund what you paid.
- Please email us before disputing a charge with your bank. It's faster, and we'd rather fix it.
What you can put up
Your photo is shown publicly to everyone who visits the site, so:
- It must be yours to use. Your own photo, or one you have permission to use.
- Brands, logos, products and businesses are welcome, including your own, as long as you have permission to use them and you're not using them to attack, mock or mislead anyone.
- No nudity or sexual content.
- No hate or harassment, and nothing that targets, threatens or demeans a person or group.
- Nothing illegal, and nothing that encourages it.
- No other people without their consent. If someone recognisable is in your photo, they must be happy to be on a public site.
- No defamatory content, about a person or a business.
We review every photo before it goes up and we can say no for any reason, including reasons not listed here. Being turned down isn't a judgement of you — sometimes a photo simply isn't right for the spot.
Taking photos down
We can take any photo down at any time, including one that's already up. When a photo is rejected or taken down, we delete the file, not just the page it was on. Copies already saved by other people, or cached elsewhere on the internet, are beyond our reach.

Your photo and your name
You keep every right you have in your photo. By putting it up, you give us permission to show it on this site and in the record of what has been on the spot, for as long as we run the site. The name you type is shown publicly with your photo, unless you choose to hide it, in which case it shows as "Someone".
The site itself
We do our best to keep the site up and working, but we don't promise that it always will be. We may change how it works, pause it, or stop running it. If we stop, any hold not yet charged is released.
To the extent the law allows, the site is provided as-is, and our liability to you is limited to what you paid us in the last twelve months. Nothing here limits liability that can't be limited by law.
Law
These terms are governed by the laws of the State of Wisconsin, United States, and any dispute belongs in the state or federal courts there.
Changes
We may update these terms. The date at the top says when they last changed, and the terms that apply to your payment are the ones on this page when you paid.
